El presente estudio trata sobre un primer ensayo codificador en la República
Mexicana. La Ley de 5 de enero de 1857 dotó de elementos comunes a los
jueces para imponer sentencias y penas pues contuvo elementos como la
responsabilidad criminal y civil; un catálogo de circunstancias agravantes,
atenuantes y eximentes, además de incluir a la prisión en el catálogo de penas
vigentes. Elementos que facilitaron la impartición de justicia en los foros,
contribuyendo a degradar las bases sobre las que se sustentaba el derecho de
Antiguo Régimen como el arbitrio judicial.
